Terms of Service

1. Acceptance of Terms
By using the swik API or website — including anonymous access, account registration, or community contribution — you agree to this Agreement. If you do not agree, do not use the Service.
2. What swik Is (and Isn't)
How inference works: swik uses a two-layer approach. A base language model provides an initial sentiment reading; the swik inversion catalog then applies asset-specific phrase context to correct or refine that reading for the security you specified. The catalog is community-built and still growing — entries vary in how thoroughly they have been validated.
swik is a research and data tool. Any action you take based on its output is entirely your own responsibility.
3. Permitted Use
You may use swik for:
- Personal use — available to all users, including anonymous.
- Academic or non-commercial research — available to all users; please cite swik where appropriate.
- High-volume or commercial use — requires prior agreement with swik. There is no self-serve paid tier at this time. Contact swik directly if you need more than 100 requests/day or intend to use the Service commercially.
4. Prohibited Use
You may not:
- Resell or redistribute raw API output as a standalone data product, feed, or service.
- Scrape or bulk-harvest endpoints beyond your agreed rate limits.
- Automate account creation or share credentials to circumvent rate limits.
- Use the Service to manipulate markets, spread misinformation, or engage in any unlawful activity.
- Attempt to reverse-engineer, probe, or disrupt swik's infrastructure or inference layer.
5. API Access and Rate Limits

Exceeding rate limits or misusing access may result in throttling or account suspension. To discuss higher-volume access, contact swik directly.
6. Your Contributions and the Open Catalog
When you submit labels, inversion hypotheses, phrase annotations, or any other contribution through swik's community features:
- You grant swik a perpetual, worldwide, royalty-free licence to store, use, publish, and incorporate those contributions into the Service and its datasets.
- Your contributions become part of the swik inversion catalog, released publicly under Creative Commons Attribution 4.0 (CC BY 4.0) and available on GitHub and HuggingFace.
- The catalog remains open and publicly available regardless of what happens to the swik platform.
- You confirm you have the right to submit the content and that it does not infringe any third-party rights.
- Contributions cannot be withdrawn once incorporated into the catalog.
7. Data and Privacy
swik collects the minimum data needed to operate the Service — including API request logs, account details, and usage analytics. This data is used to run and improve the Service, enforce these terms, and (in aggregated or anonymised form) to develop and fine-tune machine learning models. swik will not sell your personal data to third parties. 8. No Warranty
The Service is provided "as is" without warranty of any kind. swik makes no guarantees about the accuracy, completeness, timeliness, or fitness of sentiment outputs for any purpose. The inversion catalog is community-maintained and may contain errors, gaps, or unvalidated entries. Use outputs critically and alongside other sources.
9. Limitation of Liability
To the maximum extent permitted by applicable law, swik's total liability to you for any claim arising from use of the Service is limited to the amount you paid in the three months preceding the claim (or €10, whichever is greater). swik is not liable for indirect, incidental, or consequential damages, including any financial losses arising from reliance on API output.
10. Account Termination
swik may suspend or terminate your account if you violate these terms, abuse the Service, or engage in fraudulent or manipulative activity (including catalog pollution). You may close your account at any time by contacting swik. On termination, your access ends immediately; contributions already incorporated into the open catalog remain under CC BY 4.0.
11. Changes to These Terms
swik may update these terms from time to time. If the changes are material, registered users will receive notice by email at least 14 days before they take effect. Continued use after that date constitutes acceptance. The current version is always at swik.io/terms.
12. Governing Law
This Agreement is governed by the laws of the Federal Republic of Germany, with exclusive jurisdiction in the courts of Munich. Any disputes will be resolved in the courts of the Federal Republic of Germany, with exclusive jurisdiction in the courts of Munich, unless applicable consumer law provides otherwise.
